Divorce

Divorce Cases go through a process. Sometimes cases that start as contested change to uncontested cases, and sometimes uncontested cases become contested ones. There is not one set path from beginning to end with a divorce, but we will lead you down the best path in your case.

  • We have extensive litigation and courtroom experience, which means we know how to get the evidence our clients need to prove their case and we know how to effectively present that evidence in the courtroom when it really matters.
  • We provide client-focused, goal-oriented representation because we know families are unique and each client needs an individualized separation and divorce plan that is right for them.
  • We know clients going through a divorce are dealing with one of the most emotionally challenging times of their lives. We believe regular client communication helps relieve some of the anxiety clients feel going through the divorce process, so we strive to maintain a 24-hour response period to any client communication received during regular business hours.

Contested Divorce

A “contested” divorce means you and your spouse cannot agree on issues such as parenting your children, child support, alimony, property division, and debt division. Litigation of a contested divorce will last at least 7 months.  Contested divorces typically end with a hearing in front of a Judge, although sometimes mediation is successful.

If you and your spouse do not agree about all issues between you, it will be important for you to have an experienced family law trial attorney on your side to help you navigate the legal process, which will include court hearings, litigation, discovery, and mediation.

Uncontested Divorce

Divorce as early as 31 days after filing

An uncontested divorce is the quickest and least emotionally and financially draining way to divorce. An uncontested divorce is made possible by both parties agreeing (sometimes with input from an attorney) on how they want to live their lives post-separation and divorce (how they want to parent their children; how they want to divide their property; how they want to divide their debt) but don’t know where to go from there.

The party conducting the initial consultation will be the Plaintiff and will be represented by an attorney from Chandler, Britt & Jay, LLC. The other party (the Defendant) is welcome to seek outside legal counsel before signing any and all legal documents drafted by Chandler, Britt & Jay, LLC.
